By order dated 27.03.2026 passed in proceedings under Section 23 of the Protection of Women from Domestic Violence Act, 2005, the Ld. Metropolitan Magistrate, Delhi dismissed the application seeking grant of interim maintenance filed by the Petitioner against the Respondent.
The Petitioner, who was earning approximately ₹80,000 per month, had sought interim maintenance to the tune of ₹2,32,900, from the Respondent No. 1 was stated to be earning around ₹4–5 lakhs per month. During the course of detailed arguments, we opposed the application by demonstrating that the Petitioner is well-qualified, previously employed, and fully capable of earning, and had also materially concealed her additional income. It was further argued that the present application was an attempt to continue financial dependency on the Respondent No. 1 despite being employed .
After considering the material on record and submissions advanced, the Court held that the Petitioner had failed to establish entitlement to interim maintenance, observing that she is educated and employed and that maintenance cannot be granted in the absence of genuine financial incapacity.
Accordingly, the application under Section 23 DV Act was dismissed, and the matter has been directed to proceed to the stage of evidence
