Husband Discharged Under Sections 498A/406 IPC 16-May-2026 | Tripaksha Litigation Success Story

The Ld. JMFC, Mahila Court-03, Central District, Delhi, vide order dated 16.05.2026, allowed the discharge application filed on behalf of the accused-husband, and discharged him from offences under Sections 498A and 406 IPC. The Court accepted our contentions that the allegations levelled by the complainant were vague, omnibus and devoid of any specific incident, date, time or particulars of cruelty or dowry demand.

It was observed that neither the complaint nor the statements recorded during investigation disclosed any specific act attributable to the husband which would constitute cruelty within the meaning of Section 498A IPC.

The Court further noted that the complainant had earlier approached the CAW Cell and even while seeking reopening of the complaint, no fresh or specific allegations were made. With respect to Section 406 IPC, the Court held that the essential ingredients of entrustment, dominion over property and dishonest misappropriation were completely absent, and even the allegation regarding jewellery was found to be vague and unsupported by particulars. Holding that no prima facie offence under Sections 498A/406 IPC was made out against the husband, the Court discharged him of all allegations, thereby granting complete relief at the stage of charge itself.
