District Judge allowed the plaintiffs’ application under Order XII Rule 6 CPC (judgment on admissions) in a landlord-tenant dispute concerning a residential property at DLF Capital Greens, Delhi. The Court held that the defendant’s evasive pleadings amounted to clear admissions of the landlord–tenant relationship, execution of the rent agreement dated 09.04.2023, and the monthly rent of ₹45,000, satisfying the requirements for a decree on admission.
The Court passed a preliminary decree for possession, directing the defendant to hand over vacant and peaceful possession of the premises. The order reiterates the settled principle that tenancy stands terminated upon service of notice and, in any event, upon filing of the eviction suit, reinforcing the utility of Order XII Rule 6 CPC in expediting clear landlord-tenant disputes.
