By order dt. 12.01.2026 in BAIL APPLN. 4411/2025, the Hon’ble Delhi HC granted anticipatory bail to the petitioner in FIR No. 0132/2022 registered at P.S. EOW u/s 406/409/420/120-B IPC.
The petitioner was neither named in the FIR nor a partner of the concerned firm. The allegations against her were confined to being an alleged beneficiary of funds purportedly misappropriated by her husband, the main accused. It was argued that the allegations were vague and unsubstantiated, and that she had been implicated merely by virtue of her marital relationship.
It was further highlighted that there had been delay in investigation, that the petitioner had joined and cooperated throughout, and that the chargesheet qua the principal accused had already been filed. here was no requirement of custodial interrogation, nor any reasonable possibility of tampering with evidence or influencing witnesses.
