Supreme Court Dissolves Marriage Under Article 142 Following Amicable Settlement Through Mediation

New Delhi, July 24: The Supreme Court of India, invoking its extraordinary powers under Article 142 of the Constitution, has dissolved a marriage by mutual consent after the parties successfully reached an amicable settlement through mediation proceedings at the Supreme Court Mediation Centre.

A Bench comprising Justice J.B. Pardiwala and Justice R. Mahadevan recorded the comprehensive settlement which resolved all matrimonial disputes, including pending cases of divorce, maintenance, domestic violence, and criminal proceedings filed by the parties against each other.

As per the settlement terms, a lump sum amount of Rs. 16,92,000/- was paid towards full and final settlement of all claims including alimony, maintenance, and streedhan. Additionally, original LIC policy documents, household items, jewellery, a car, and other personal belongings were handed over as part of the settlement. Custody arrangements for the minor child and visitation rights were also amicably decided.

The matter was represented on behalf of the Respondent by Advocate Divya Tripathi, who facilitated the smooth culmination of the legal proceedings through effective mediation and legal negotiation.

The Supreme Court appreciated the efforts of the counsels and the Mediation Centre in resolving the matter and directed the registry to draw a decree in terms of the settlement, thereby terminating all civil and criminal cases between the parties.
