Drafting a Child Custody Petition

Drafting a Child Custody Petition

When a couple goes through a divorce or separation, child custody is often a contentious issue. Some of the common allegations that may be made in a child custody petition in India include:

Allegations of neglect: One parent may allege that the other parent is neglecting the child’s physical or emotional needs, such as failing to provide adequate food, clothing, shelter, medical care, or education.

Allegations of abuse: One parent may allege that the other parent is physically, emotionally, or sexually abusing the child or exposing the child to dangerous or harmful situations.

Allegations of parental unfitness: One parent may allege that the other parent is unfit to have custody of the child due to issues such as substance abuse, mental illness, criminal history, or domestic violence.

Allegations of parental alienation: One parent may allege that the other parent is intentionally or unintentionally turning the child against them, either by bad-mouthing them or by interfering with their relationship with the child.

Allegations of relocation: One parent may allege that the other parent is planning to relocate with the child to another city or country, making it difficult for them to maintain a relationship with the child.

It’s important to note that these are only allegations, and it’s up to the court to determine the best interests of the child and make a decision regarding custody based on the evidence presented.
