RAREST OF RARE FEAT ACHIEVED In the courts of Uttar Pradesh they take accused in custody even in bailable offences, it is mandatory there that accused has to be in custody for 4-5 hours irrespective of offence i.e. bailable or non bailable , this is the law and practice there. We applied bail for our client xyz for the offences u/s 498a, judge had taken our client in custody as he had already taken 6-7 other accused persons in custody but we were able to get our client released very that moment after our arguments. We secured bail for our client without sending him in custody. Even our client got shocked that how he got released when other accused persons in similar offences were taken in custody.
