Karkardooma Court Rejects Wife’s Claim for Interim Maintenance and Residence Rights 25-April-2025 | Tripaksha Litigation Success Story

The Complainant (wife) had filed an application under Section 23 seeking interim reliefs in the form of maintenance and right to reside in the alleged shared household.

We, appearing on behalf of the Respondent (husband), submitted that the premises in question, claimed by the Complainant to be the shared household, was never resided in by her at any point of time. This fact was substantiated through the material available on record. It was further pointed out that the Complainant had a history of filing multiple criminal complaints, and her previous conduct did not support her claims. Additionally, it was brought to the Court’s attention that the Complainant was previously employed prior to the marriage and had willfully chosen to remain unemployed thereafter.

Upon hearing both sides and considering the submissions and documents on record, the Hon’ble Court was pleased to reject the Complainant’s application, holding that no case was made out for grant of residence rights or interim maintenance.
