How Long Can Police Keep You in Custody in India? Full Law Under BNSS, Article 22, and Supreme Court Rules
In India, police cannot keep an arrested person in custody on their own authority for more than 24 hours, excluding travel time to the Magistrate. Any further detention requires a Magistrate’s remand order. Under Section 187 of the BNSS, police custody is restricted to the initial statutory period, while longer detention may be judicial custody. Depending on the offence, investigation-related detention may extend to 60 or 90 days, after which the accused may become entitled to default bail if legal requirements are met.
