I had the opportunity to represent the petitioner before the Hon’ble Supreme Court in a Special Leave Petition challenging the order of the Hon’ble High Court dismissing his application for anticipatory bail.
It was submitted that the impugned order was unreasoned and failed to adequately consider material circumstances in favour of the petitioner. It was highlighted that the petitioner had already joined and participated in the investigation and had remained under interim protection, first granted by the Ld. Sessions Court and subsequently by the Hon’ble High Court, without any allegation of misuse of liberty.
It was further submitted that the investigation had already been completed and the chargesheet filed without the petitioner being taken into custody. The petitioner was residing in a different State from the complainant, and there was no requirement for custodial interrogation.
Upon consideration of the submissions, the Hon’ble Supreme Court was pleased to issue notice in the Special Leave Petition and grant interim protection from arrest to the petitioner.
