What is Maintenance as per Law in India?
As per Section 3 (b) of the Hindu Adoption & Maintenance Act, 1956, maintenance is :-
“in all cases, provisions for food, clothing, residence, education and medical attendance and treatment; in the case of an unmarried daughter, also the reasonable expenses of an incident to her marriage.”
Section 125 of the CrPC provides for maintenance of wives, children and parents. The maintenance law in India states that it is the duty of a man to provide maintenance to his parents, wife, and children when they are unable to maintain themselves. Maintenance in law is defined as the amount which is paid to the dependent wife, child, or parents to maintain themselves. Courts have tried various methods to arrive at a reasonable maintenance and 25% of the net income has been taken as a bench mark as maintenance to an estranged wife, who is unable to maintain herself. Even when a wife is working, maintenance has been awarded to her looking into the status of the husband. This is further disincentivised the men to earn higher income and incentivized women to hide their income.
